Part Two: Current consultations
This is the Office's email update of 26 August 2008.
08: Health Practitioners Competence Assurance Act 2003 Review: Further Sector Engagement.
Section 171 of the Health Practitioners Competence Assurance Act requires the Director-General of Health to review the operation of the Act and report to the Minister of Health.
The Ministry of Health has completed the first two phases of the review. In the first phase the Ministry gathered information on how the Act is operating. In the second phase the Ministry held three workshops to help develop proposals for change.
The information gathered so far notes that the Act generally seems to be operating as intended and there is no need at this time for major legislative change. There are clarifications and improvements to be made in a number of operational areas including the number and nature of regulatory authorities, appointment processes, collaboration between authorities and engagement with the sector, development of scopes of practice, restricted activities, registration processes, competence and fitness to practise and funding the Health Practitioners Disciplinary Tribunal.
In order to draft the final report to the Minister of Health on the outcome of the review, the Ministry of Health will continue engagement with stakeholders through workshops and discussions, in order to test out proposals. Three open workshops will be held in September.
